Background: Last month, staff presented proposed actions to address changes made to several FTA formula programs that were modified under the Moving Ahead for Progress in the 21st Century Act (MAP-21). As a result, the TTC has temporarily delayed the procurement process on SH 360 pending resolution of the unrelated legal matters. The good news is TxDOT informed the potential contractors by reducing the original list from nine to five contractors. Background: The Mobility 2035 – 2013 Update was adopted by the Regional Transportation Council in March 2013 and serves as the current long-range transportation plan for the Dallas-Fort Worth region. Since that time, transportation partners have continued to develop and refine projects recommended in the long-range plan. The Plan will be strategically amended to accurately reflect the latest project-level assumptions on a small number of corridors seeking environmental clearance before the end of 2015. These strategic amendments will allow projects to meet critical deadlines and progress towards implementation. Electronic Item 10 provides additional details.
Texas Department of Transportation National Presenter: Sandy Wesch, NCTCOG Item Summary: Staff will provide an overview on the new responsibilities that the Texas Department of Transportation (TxDOT) will assume from the Federal Highway Administration (FHWA) regarding the review and approval of National Environmental Policy Act (NEPA) documents. Background: As part of the Moving Ahead for Progress in the 21st Century Act (MAP-21), Congress established a permanent program to allow states to assume the responsibilities of the FHWA for NEPA and related laws under the Surface Transportation Project Delivery Assignment Program (NEPA Assignment Program). Through a Memorandum of Understanding, FHWA has formally assigned responsibility for the review and approval of Categorical Exclusions to TxDOT. By late summer, this authority will also be extended to Environmental Assessments and Environmental Impact Statements. The principal goals of this effort are to streamline the environmental process and deliver projects faster while meeting federal environmental protection standards. FHWA will still maintain responsibilities for engineering decisions, air quality conformity determinations, consultation with tribes, and metropolitan planning. FHWA will audit the program and TxDOT will report quarterly on project approvals and decisions.
Bicycle/Pedestrian User Count Program Launch Presenter: Karla Weaver, NCTCOG Item Summary: Staff will provide an update about the initial installation of bicycle/pedestrian facility user count equipment and planned data-gathering efforts in the region. Background: To support effective bicycle and pedestrian planning in the region, the North Central Texas Council of Governments (NCTCOG) is launching a program in 2014 to collect bicycle and pedestrian facility use counts. NCTCOG recently purchased equipment and local jurisdictions are participating in a pilot program to install permanent counters at several locations on paths (trails) in Collin, Denton, Dallas, and Tarrant Counties. The first counters have recently been installed. Mobile counters were also acquired by NCTCOG and are available to local jurisdictions on a loan basis to conduct counts on paths and on-street bicycle facilities.

Staff will discuss whether the RTC desires to establish additional procedures in addition to those required by Chapter 171. Background: RTC Bylaws and Operating Procedures requires RTC members to adhere to the conflict of interest procedures in Local Government Code Chapter 171 and the Code of Ethics of their respective entities. (See RTC Bylaws, Section 3, Paragraph D). If an RTC member, or close relative(s), has a substantial interest in a business entity or in real property that is coming before a vote of the RTC, the member is required to file an affidavit prior to the meeting stating the nature and extent of the interest. The member is required by law to abstain from further participation in the matter if action on the matter has a special economic impact on the business entity or value of the property that is distinguishable from the effect on the public. The member is required by law to abstain from further participation in the matter if action on the matter has a special economic impact on the business entity or value of the property that is distinguishable from the effect on the public. Electronic Item 13 is the Conflict of Interest Affidavit that meets the statutory requirements for use by RTC members. Some local governments have adopted additional requirements above those in Chapter 171. For example, some local governments require members who abstain to also leave the meeting room during such items. Staff will engage members in a discussion on whether the RTC desires to consider additional conflict of interest procedures.
